Please read these Terms and Conditions carefully before using our booking platform and website (the “Service”). By accessing or using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, please do not access the Service.
1. Definitions
The following terms apply throughout this Agreement:
- “Affiliate” means any entity that controls, is controlled by, or is under common control with a party, where “control” means ownership of 50% or more of voting shares or equivalent authority.
- “Company,” “We,” “Us,” or “Our” refers to Bartram Beach Homes.

- “Service” refers to the Bartram Beach Homes website and booking platform.

5. Limitation of Liability
To the fullest extent permitted by applicable law, the total liability of Bartram Beach Homes and its suppliers under these Terms shall not exceed the amount you actually paid through the Service, or $100 USD if no purchase was made. In no event shall the Company or its suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, business interruption, personal injury, or loss of privacy arising from your use of (or inability to use) the Service — even if we have been advised of the possibility of such damages. Some jurisdictions do not permit limitations on liability for incidental or consequential damages. In those jurisdictions, liability will be limited to the greatest extent allowed by law.
6. “As Is” and “As Available” Disclaimer
The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, either express or implied. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

9. United States Legal Compliance
By using the Service, you represent and warrant that: (i) you are not located in a country subject to a United States government embargo or designated as a “terrorist supporting” country; and (ii) you are not listed on any United States government prohibited or restricted parties list.
10. Severability and Waiver
If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to achieve its intended purpose to the greatest extent possible under applicable law, and the remaining provisions will remain in full force and effect.
The failure of either party to enforce any right or obligation under these Terms shall not constitute a waiver of that right or obligation. A waiver of any breach shall not be construed as a waiver of any subsequent breach.
11. Changes to These Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will make reasonable efforts to provide at least 30 days’ notice before the new Terms take effect. What constitutes a material change will be determined at our discretion.
By continuing to access or use the Service after revisions become effective, you agree to be bound by the updated Terms. If you do not agree to the revised Terms, please discontinue use of the Service.
